About these terms
Fallon Pilott Surveying Services Ltd runs this website. Our company number is 17195307. Our office is at Rodney Chambers, 40 Rodney Street, Liverpool L1 9AA. We are regulated by the Royal Institution of Chartered Surveyors (RICS). These terms cover your use of the website and the way we handle enquiries. They do not replace the terms of engagement we issue when you instruct us. In these terms we call that document your agreement. For any survey or valuation, your agreement comes first.
Enquiries and quotes
A request for a quote through this website is an enquiry, not an instruction. We reply the same working day with a fixed fee and the dates we can offer. We confirm the fee in writing. It stays open for the period stated in the quote.
An instruction starts only when two things happen. You confirm the quote in writing, and we issue your agreement. It sets out the scope of the survey or valuation, the fee and the payment terms. It also sets out the limits of the report.
Surveys and valuations
We carry out surveys to the RICS Home Survey Standard, at the level set in your agreement. They cover the parts of the property that can be seen and safely reached on the day. We do not open up the structure, lift fixed coverings or test services, unless your agreement says so.
A RICS Registered Valuer carries out every valuation. They follow RICS Valuation Standards, known as the Red Book. Each one is for the purpose stated in your agreement. A valuation for one purpose may not be relied on for another.
Reports
We prepare each report for the client named in your agreement, and for the purpose stated there. Nobody else may rely on a report without our written agreement. A report may need to go to a lender, a solicitor or another third party. If so, your agreement says so.
A report describes the property on the day of inspection. Conditions can change. Do not rely on a report after the period stated in your agreement.
Cancellation and changes
You may cancel an instruction before the inspection. We may already have paid costs, or the inspection may be cancelled at short notice. In those cases, your agreement sets out any charge. Sometimes we cannot inspect on the agreed date. That may be for a reason within our control, or for one outside it, such as weather or access. We then offer the next date we can. If you prefer, we refund in full any fee you have paid.
Liability
Your agreement sets out our liability for the survey or valuation. Nothing in these terms limits our liability for death or personal injury caused by our negligence. Nothing limits it for fraud. Nor do these terms limit any other liability that the law does not allow us to limit.
This website gives general guidance about surveys and valuations. It is not advice about a particular property. We accept no liability for decisions based on the website alone.
Complaints
We are regulated by RICS, so we have a complaints procedure. You can ask us for a copy. If we cannot settle a complaint, you may take it to the independent redress scheme. That scheme is named in the procedure.
Using this website
You may use the website for your own information and to contact us. The content, design and photographs belong to us or to those who license them to us. They may not be copied without permission. We aim to keep the site available and accurate. We do not promise that it will be free of breaks or errors.
Our Privacy Policy explains how we handle personal data.
Governing law
These terms are governed by the law of England and Wales. The courts of England and Wales have jurisdiction over any dispute about them.
